22 Dec Lifting of an Agricultural Occupancy Condition

This was an interesting case where, prior to instructing The Rural Planning Practice, the clients had spent 20 years and a considerable sum of money attempting to lift an AOC on their property.

The clients had bought the property and had never met the AOC employment requirements. Numerous applications to lift the condition had been submitted without success and the clients were facing enforcement action before coming to us.

We were able to spot a legal angle that none of the previous agents had investigated. A successfully Certificate of Existing Lawful Use was applied for and vigorous defended despite local opposition. Our legal argument and the issuing of the certificate resulted in the condition no longer being enforceable by the Local Planning Authority.

This successful outcome ended years of uncertainty and stress for our clients.
