04 Jul Objection to Class Q Application
We assisted our clients in making an objection to the conversion of three existing agricultural buildings into three residential dwelling houses via Class Q permitted development which led to the application being withdrawn.
Whilst objections from neighbours are not normally a material consideration for Prior Approval applications we set out points addressing the fact that the building had not been in agricultural use and picked up on technical elements which the applicants had failed to meet. There was no evidence provided by the applicants on the potential for bat roosting, and there were a number of ponds which provided suitable habitats for Great Crested Newts. Our clients provided sworn statements confirming that the buildings had not been in agricultural use at the required time.
