From Agricultural to Residential – A Certificate of Lawfulness Granted

We recently achieved a Certificate of Lawful Use for the change of use of land from agricultural to use as residential curtilage.

Our client purchased a field adjoining his garden in 1988 over the following years he painstakingly developed the area planting trees, shrubs and plants. We provided a sworn Statutory Declaration and Exhibit detailing how the change of use took place including the activities carried out and what the land was used for. Detailed receipts, invoices and plans dating back to 1988 were also submitted to substantiate our claim. This shows the importance of keeping records of historic transactions as these, along with aerial photography were crucial to the change of use being proven.
